Good to have you with us. Six minutes after top of the hour, right now, Michae O'Neil from Landmark Legal joins us. Now, Hey, Michael, good morning. Morning, Bill. Good to be with you. Hey, let's to catch up on of course, people are still waiting on the decision regarding terrorists from SCOTUS. I just my gut tells me, as I was saying to you just a moment ago, that this is a tough decision for them because of what hangs in the balance here. Trump is presenting his case to Davos even as you and I are talking right now. I think it's pretty compelling what he's laying out for them, that America has done so much for Europe, for NATO, and we've gotten little in return. And this is a small ask compared to all that you know America has done and so and and the thing is is all a lot of what's happened economically has been set up by tariffs, including drug pricing and other negotiations negotiations for peace. All that has been affected because of the president's ability to exercise, you know, tariffs on these nations to get them to behave.

1:29 You know, this may it's certainly practically speaking, it's certainly a very powerful tool in the president's arsenal to use. I mean, it's it allows him a lot of diplomatic leeway in negotiating relationship relationships with or negotiating issues with our foreign partners or adversaries, whomever you want to talk about. And I think that's probably from a legal perspective, is one of the stronger arguments that support his uh that the support the argument that he has the authority under this particular provision of the law to do what he's doing. And keep in mind, generally speaking, a couple of things is the Supreme Court, particularly this iteration of the Supreme Court, is loath to involve itself in foreign policy. You know, traditional powers of the executive and what is what is one of the biggest power of the executive of the president has is of course, is to deal with foreign governments, right, is to unify He's the representative of the United States when negotiating with other countries and conducting diplomatic relationships waging war.

2:33 So we know when the president is under is embarking in these negotiations and foreign relations, he's operating under the strongest of his constitutional authority. And I think that that at oral arguments. I think that the Solicitor General repeatedly discussed that, and so the court is probably aware of this. And you see, so that's that's legally. Then you see the practical issues that have been presented with this. Over the better part of a year now, the president has utilized this power to negotiate. I don't know what the number is, but I mean, I think it's got to be in the dozens, right, I mean, it's a significant number of new trade deals are with foreign both countries that are our allies, you know, quote unquote allies and adversaries or potential adversaries. So the horses out of the barn, hundreds of billions of dollars have come into the US treasury, a lot of a lot of new trade deals have been executed. There's been a lot of reliance on it with businesses.

You know, people who who argue against tariffs have will argue that that it's cost them domestic companies have argued that it will have cost them millions of dollars, so they they'll argue that they have a claim and they that these were the impropriety of the levee. So just a lot of moving parts with this. But my my general feel, and again it's it's really hard to discern what's going on. But the fact that every week goes by, now that the court hasn't ruled on this, you have to conclude or you have you can conclude that there's a lot going on behind the scenes that the court isn't able to speak with one voice. Right, if it was an easy if it was an easy opinion, if it was a nine to zero one or an eighty one opinion, we would have already heard about it. Right, If there was an easy answer out there, the court would have already given it to us. So, uh, you know, I some people, some people conclude that every week that goes by increases the likelihood that they're they're going to rule in Donald Trump, in the president's favor in this.

4:31 I'm not quite there yet, but I certainly think that I will conclude that it's a it's a complicated issue. You're you're talking probably you know, you don't have unanimity between the justices. I don't think now you're ever going to have unanimity in with the justices because of the delay here. Perhaps the Chief Justice is delaying this and trying to cobble together as strong an opinion one way or the other so that the Court can speak with one voice to the extent that it does. I think it's a challenge for the Court because we're talking business here, and what does the court know about business? I mean, traditionally, what is the country. There's not been a president like Donald Trump who has said, look at I'm going to leverage the assets of America to our benefit as opposed to just writing checks and being an ATM for the you know, for the European nations. Yeah, you know, and uh, you know. So now you've got this dynamic coming into place at play. And then uh, and then you get the argument from from Congress and the legislature saying, wait a minute, that's our job. Well why have you been doing it?

5:35 I know that's that's that's a really fantastic point. And and uh, the fact that you know, the Supreme Court could put its hands up and say, look, Congress has the power to limit the president. We've given them weeks, months or to to do this to to profit and it's Congress's job here. This is a political issue. We're going to stay out of it. That's that's another good argument for for the president simply saying, but Congress, if Congress wanted to stop this, it could and it hasn't. So we're not going to do this because it's an issue for the it's it's an issue for Congress to deal with. That's certainly a very good point. I am on the other side, also, I wish I wish Congress had just, you know, open the door, you shut the door on the legal issue and simply said, yep, we're sending the president's power to do this in this context.

6:21 But exactly they could. They could have just said exactly for that context. So it doesn't give him unlimited forever power. But in these particular cases, it says, Okay, we we endorse and support the president's authority to do this. Yeah, and this is again I don't think there's a I don't know if it's a necessary supermajority, but I mean the House having he hasn't even proposed legislation or past legislation by a majority. Uh, I mean, you got to think that there's a number of Republicans. Enough Republicans on board. Obviously, the Democrats are on board with thinking he doesn't have this, and they just don't want to deal with it, so they're just gonna put there. Well, they don't want Trump to have another victory. Trump's had too many wins for their soul. It is driving them nuts. I mean, their brains are exploding. Gray matter is all over the Beltway. You know that belongs to the Democrats. It's going to be quite a cleanup. But that's just who they are right now. Sadly as opposed to here, we have an opportunity to really solidify the country's position in the world, secure our national security, financially, realize this golden age that I believe is right on the horizon. That look everything, I mean, the stock market, drug prices, you know, getting a handle on this illegal immigration, holding these states into account for you know, the proper spending of federal funds. All this stuff looks very positive.

7:46 Michael, absolutely, you know, and we'll see whether the systems slow it down. We're seeing what's happened in Minnesota where there's I think every day goes by, we're seeing more and more there's fraud, rampant fraud. Uh. Obviously, I mean I'll go so far as you use this conspiracy to obstruct the enforcement of ice, conspiracy by state officials, local officials to to obstruct Uh. I think it's beyond conspiratorial. I mean doing it right. Yeah. Well, when I say conspiracy, I'm saying criminal conspiracy with the with all the attributes of a criminal charges. So I mean criminal conspiracy which would of course open you to prosecution for those for those cases which I you know, conspiracy generally, but conspiracy specifically with regards to violations of federal criminal statutes. So I think that, uh, yeah, there's a lot. It's not going to be easy. No nobody ever said that this was fixing our country was ever going to be easy because of the problems. I think that, you know, doing the common sense thing is it sets us on the path. And that's what we've done the past year. We've started to do the common sense things.

8:56 But of course now you're having these institutional blocks to it, and of course those are challenges to overcome, slowly but surely. Regarding just real quick to step. I think we'll I'll. 13:47 And we're back with you. Michael Neil from Landmark Legal continues with its Michael, I interrupted you. I apologize, but. Well that's fine, go ahead. No, I was just thinking we could put a hold the terrorists decisions out there. It's still pending, I think as of today, you know, maybe in maybe within another week, the Supreme courtal announced opinion opinions, and we'll we'll we'll hold fast and it'll come to some sort of vague consensus on this. My hope, of course, now, is that that there is an authorization or limited authorization saying that he can do this every day that goes by probably works in Donald Trump's favor, so that that's that's some some silver lining in that or some good news possibly on that front. Regarding, of course, the hurdles that the President and the administration are facing regarding our enforcement of our immigration laws. Obviously you're seeing that coming to a head in Minnesota. I think that's a really kind of an encapsulation of all the problems that we've encountered with having open immigration for the past however many years you want to you want to talk about it, I would say obviously the Biden administration, but Hargins back even into the Obama administration.

14:47 Oh, yeah, without a doubt. Yeah, And I think I think we're just looking at the tip of the iceberg. But let's go back for just a second though, Uh, getting back to the terrace. Yeah, what do you see as the key obstacle here? Yeah? Yeah, the chi obstacle I think was encapsulated by Justice Gorsich in oral arguments when he said, if we allow the president to declare an emergency in this context, then what's to stop future presidents from declaring emergencies in other under this statute and then instituting tariffs or instituting some sort of economic action into effectuate their agenda. In other words, I think the point was, Okay, say hypothetically speaking President Kamala Harris or Gavin Newsom are in office and they want to declare a climate emergency. Therefore they want to prohibit the importation of any gas power gas power vehicles.

15:36 Do they have that power? And I think that that was a good encapsulation of the problem with opening up that door into broadly interpreting the or showing extreme deference to what the President of the United States terms as an emergency under this statue. So that's the problem, and so you have obviously you have that's the conservative argument for it, and I think that was a really good argument. Here is that you want to be very leery of broadly interpreting these statutory terms in such a manner. Is that the president has almost virtually unlimited authority under these sorts of things. You know, if it's an emergency now with our general trade, our traded agreements with Europe, if that's an emergency, then anything could be an emergency. Therefore, any president can use that emergency term to do whatever they want to do.

16:27 Well, the American people endured a goofy emergency authorization under COVID, Michael, and look what happened. And that way the matter is, the EAU did not have predicate to be established because there were drugs that could handle the problem. But they lied to. Us, right, and we all and we all took issue with the fact that you were declared using this Again it's the same sort of thing. You were using this cover of emergency to effectuate tyranny, right exactly. That's the concern here. So you have to you have to define these you have to constraint you. Generally speaking, we want narrow interpretation of statutory terms. We don't want broad interpretation of this statutory authority because of course, if you if you allow broad interpretation of statutory authority in these cases, you allow you know, government, you know, you allow presidents who are diametrically opposed on their in their philosophy to use the cover of that statute like they did in COVID, like exactly what you were talking about. So that's really the argument here is that's saying, hey, if you broadly interpret emergency, then any president can use emergency for to do whatever they want. And they've done it and they're going to continue to do it, and so we can't. We can't broadly interpret this this statute. So that's and I think there's obviously something to that argument. As a as a conservative, as a constitutional conservative, I really my default is limiting the authority and power of government. Even when the president is acting consistent with something I agree with. You know,

17:57 I might agree with him from a policy standpoint, from a legal perspective, I might say, wait a minute, do you really have that power to do this? Now? Again, specifically with tariffs. You know, there's some argument, there's some really strong arguments to say, yes, he does have this power. This is again foreign you're talking about foreign negotiations, you're talking about possibly this is an emergency in some ways, they can make that case. So there's certainly some arguments on both sides of this that I think will merit. And again, these are the issues that the Supreme Court is struggling with. Well, we continue to to sit and wait and wait, and and I'm optimistic. I'm like you, I'm encouraged every day that it takes Scotus a little bit longer, because I mean, it definitely demonstrates to everybody that this is a deliberative body and they're doing they're doing their job, and you know, so anyway, we're grateful for that. But getting back to what's happening in Minnesota, I mean, this is a law and order, a fundamental law and order deal, and they're out of control. I mean, they are obliterating the boundaries of law in order. And the thing is what they're demonstrating, and it seems to be consistent with Blue states and especially states that have embraced sanctuary policies.

19:12 It's like, how much of this junk is going on? And I mean, I got to think these other Blue states, they're probably taking a second look and going, hey, are we going to be vulnerable here because of what happened with Little Somalia there in Minneapolis? Is this going to open us up for liability? And I would say you better get your acts together, because yes it is, because this is just a tip of the iceberg. Because the American people are ticked, they're not real happy about this. Yeah, it's amazing, it's really almost we don't have enough time today to unpack what's going on in Minnesota because there's just so many different issues to address, specific you know, to address. For example, let's just let's just look I mean, you're talking about the rampant fraud that's going on, taxpayer fraud, We're talking about the issues with with obstructing ICE enforcement actions.

20:04 You're talking about menacing people in churches. I mean, so the. ICE or the ANTIFA insurrectionists have become so emboldened that they feel that they can go into a church where people are worshiping on a Sunday and menace the pastor of the church because they believe he is an ICE, he's working with in cooperation with ICE, or functioning as an ICE agent. So that's enough for them to justify storming into a church where families are praying and worshiping God. Right, say, Okay, we're gonna We're so embolden that we feel that we can do this. And I think the Department I want to say this. You see commentators in the Twitterati and the exceriti and everybody talking about why hasn't prosecutions happen.

20:45 Let's caution patients. I want just like we were talking about the Supreme Court, we want patients here. We know this is a hostile jurisdiction. You're gonna potentially have hostile jury pools, You're gonna have judges that are probably gonna be be predisposed to be rule against the Department of Justice. So everything has to all the eyes have to be dotted, all the teas have to be crossed, And so I urge patients in this and allow the justice process to proceed, and allow the Department of Justice and the prosecutors on the ground there to solidify their cases before they start charging individuals, because we know they're going to have smart lawyers who are representing them, the accused in these cases, and of course that the Department of Justice has a high burden. Remember beyond a reasonable doubt. These are criminal matters we're talking about. You want to have all your ducks in a ligne before you initiate these criminal processes.

21:31 Well, of course, and you've got Keith Ellison, their Attorney General, running interference. He's been recorded, so there's documentation that he has been more than willing to cooperate with this lawlessness and this fraud. Yeah. Yeah, it goes to the highest levels in the state government. And I think that's why again why you saw the subpoenas that were issued by the Department of Justice, because you need to begin gathering evidence. Now those could have been on a number of matters. I apologize for that. Those could have been on. A number of matters, but particularly I think we're talking about you know, it could be on the fraud, it could be on obstruction of the ICE of ICE officials. There could be just a number of matters that we could be dealing with here, So it could be anything.

22:16 So again I urge patients in this process. We'll see what happens. Well, there's a clear delineation between the states that have been like you know, La and Minneapolis attacking ICE and these other states that have cooperated, including some Democratic controlled states, have said yeah we need your help. You know, cities Memphis and Louisiana said yeah, we need your help. So yeah, yeah, exactly. I think you have cooperate. You have jurisdictions that want to cooperate with this and enforce the law, and then you have jurisdictions that are going to oppose this. Obviously, Minnesota is the test case. They're trying to run as much interference as they can to slow the enforcement of these laws. Democrats clearly don't want are not on board with this, and we will see what happens going forward. I think I think again, patience is the watchword of the day. Let's give the Department of Justice the time to amass these cases so that when they do bring these lawsuits, you know, they hold water and they're actually substuent enough to survive all the procedural hurdles that sophisticated lawyers who represent the accused are going to raise.

23:21 Well, Micha O'Neil, I think that that's that's good advice is for us to calm down. We've got to wrap things up. And I appreciate you coming on the show. You need to really embrace, and that is have some patience, allow the process, you know, to work itself out so that wisdom can win out. And that's that's what we want, you know, for everybody. But it is difficult to watch what's happening, you know, the kind of lawlessness that's happening there in Minneapolis and in other areas of the country, and you know, the way you take care of it in most cases is you do it with rapidity. In this particular case, you know, the Justice Department has an option to, you know, maybe be a little bit more deliberate, and of course that's upsetting some of us that want to bring this to a conclusion, and we realize that from past experience, the best way to do that is to do it with expediency. Even the Word of God says the reason that sin bounds and gets more complicated is because it's not addressed with right away. So I'll leave you with that note. You know, Jack Smith is on Capitol Hill. I don't know these things. Sometimes they frustrate me because like as if Jack Smith's going to say, yeah, you got me, I did you know? I'm weaponized, Like he's going to roll over. But you know, as Jonathan Turley said, the problem with Jack Smith is his record talks louder than his lips. That's right. Yeah, Well this guy is you know, he's went after President Trump is you know, I was well known, you know, chasing him from one courtroom to the next. And the whole kind of basis of his of his concept was that it was illegal for President Trump to object to the twenty twenty election and to point out areas or of concern, whether it be ballots that were not counting properly, mail in ballots popping up at strange hours of the night, a whole bunch of sectaries of state and governors and other people changing the rules of the election, which is something only state legislatures could do according to constitution. And oh it's illegal, you can't look you can. You can object to an election. You're allowed to do that, and you have a First Amendment right to say that. Whether you're you know, Bob Smith walking down the street or Donald J. Trump President of the States.

30:12 There's no violation the First Amendment there. And of course he says, oh, and then you know, I'm hearing all these people in this testimony saying oh, Trump ordered his ordered his supporters to attack the US Capitol. Note can do that? He said he wanted to go forward peacefully and patriotically any the word attack anywhere there. And they had every right to show show up in to hear his speech, at every right to go and protest in front of the US Capitol. And they didn't have not did not have right to kick in the windows and break in the windows and kick the doors down, which some of these courage people did. And anybody who engaged in violence and destruction like that and vandalism needs to be prosecuted. But the other folks who are protesting peacefully should be left should have been left alone. You have people who didn't even getting near the Capitol, they were just watching Trump's speech, and the FBI showed up at their door saying what were you doing in Washington, d C?

30:54 I mean, really ugly, kind of East Terman style stuff against people at every right to show up, I'd say, we don't like the way the election was handled. We think it was fishy, and we're exercising our First Amendment rights to express that. And they hope that the Congress does something about it. That's perfectly okay, perfectly constitutional. In Jectsmith should add no business going after President Trump or anybody else for that sort of behavior. Exactly, well, sixty percent over sixty percent to this day, Deroy believe that the election, the twenty twenty election was fraudulent and corrupt, and of course all these things that were brought up along the way about miscounts of votes. I mean, what do we have three hundred and fifty thousand votes just in Georgia alone that they've since come in and going, uh oh yeah those were illegal and they counted. Oh would that have made a difference in Georgia, you know, going to Trump and determining the election, You bet it would. I mean Johnald Trump, you know, asked the Secretary of State, Hey, just do you know can you go find me eleven? All I need is eleven thousand votes, can you? I mean kind of an addic donal statement. And they read that as if somehow Donald Trump was holding a gun to his head, right unlike well I did to Facebook.

And you're right, they had all these votes that they've determined subsequently were It's just the same proper one way or the other. And the quote the Washington Post actually is a full transcript of the telephone call that President Trump and his lawyer's had with the Referensburger, the Secuary of State of Georgia and his team and Trump people say, Trump said, go find me eleven thousand votes or ten thousand, and the number one. He said something like all I need is nine thousand votes, all of these eight thousand whatever. Then I forget the number right now. Now, there's difference between saying all I need is versus go get me or go find me. You know, if I say to you, hey, Bill, you know all I need is you know, three hundred thousand dollars, and I could, you know, put a down payment on a boat at Lake House. That's different from saying, Bill, please go in to the bank and rob three hundred thousand dollars and bring me the cash and I'll use it down payment. Okay. Trump says, I just need this amount of votes. That doesn't tell anybody to do anything, and it has been interpreted, is that go get me?

And so I've even heard people you'd think, you know, people in our stiety should know better, who've just repeated this because we've heard it over and over and over again. And no, Trump never did say that, just as he never said that the KKK and the Nazis were really really find people are very fine people in Charlottesville. He said the KKK and the neo Nazis need to be condemned. Totally. Nobody talks about that. So nobody ever talks about the actual quote that Trump made, which had nothing new, the coercion, It just this observation that all they needed was he said, all they need is I think ten thousand votes and I win the election in Georgia. And that's all he said. So there's a lot there are a lot of the there's a lot of confusion, a lot of misinform or information, and a whole lot of outright lies. But yet everybody forgets that, and you know, because she's a Democrat, and of course who she is, you know, they get away with it. But meanwhile, everyday Americans exercising their constitutional rights are the ones that end up in solitary confinement. And we've had what how many a couple of suicides from these people that were so weaponized, you know, by the Biden administration and just brought to such despair that they lost hope and killed themselves.

Hey, we've got ten thousand troops available at National Guard troops to keep things calmed. On January sixth, and Nancy Pelosi said, now we don't want him and Murroe Bowser send a letter, and the letters available online you can look at yourself where she says, basically, I'm instructing the National Guard to stand down. We don't want you there. We just want the DC Police Department tell the National Guard not to show up and unless we tell you otherwise. And they said, okay, fine, we'll stay out of it. And guess what happened, you know, chaos. Now, if Donald JE Trump really wants people to attack the US capital, do you think he also would ask and make available ten thousand troops to stand the way as his people attack the capitol. That makes no sense. I'd be like you and I saying, Hey, let's go up rob the JP Morgan Chase Bank over there at ten

And you know, the people who are getting robbed here, as I think we discussed this last week, these people are robbing from autistic children, and they literally are taking money that's allocated to benefit children with autism and then using that to rip off the government and basically rob from autistic kids.

I mean, man, I tell you that's your concern about children? Boy, keep my kids away from you.

And these folks are not just engaged in a little bit of jay walking or maybe not paying their parking tickets. I mean, these are terrible, terrible people, and they've got just a handful of them. I mentioned this piece. You've got a guy named a Non Cortes Valencia. He's a Mexican illegal alien who's convicted, not indicted, or charged or suspected, convicted four DUIs, sexually assaulting a child and cardinal abuse. He had a deportation order from December twenty sixteen and finally got arrested.

You've got another another character here who is from let's see, he's from I believe he's also from Laos and he was brought in for let's see, convicted of strong arm aggravated assault against a family member, a strong arm rape, aggravated assault with the weapon, domestic violence involved extrangulation. So this guy's involved in strangulation. He was brought in. Then you've got these people killed people. They're not just robbing and raping. You've got a Guatemalan illegal alien name of Alare Gomez Lucas convicted of dui negligent homicide of the vehicle. You've got somebody else who was Let's see, this is Gambriel figureau Agama, this Mexican illegal alien convicted of amphetamine possession, battery, assaultant homicide. Maria Mariam Siakuna Kanyua, because I said, from Sierra Leone. She was convicted of burglary, three counts of larcenity, fourtuis, and two counts of homicide. And there's another guy in here named called Doches Silgera londe Verde from Salvador. He was convicted of three counts of homicide. So these are not just killers. These are multiple killers of the multiple dead bodies, and people who are taking kids and putting them into child prostitution and raping them and so forth.

These are vicious, blood thirsty killers and child rapists are being taken off the streets and deported in many cases people with deportation orders, which means that they've gotten the the due process that everyone needs due pross. Okay, they got their new port due process, they got deportation orders. They should have been deported in one case one of these guys. Uh, this is again from my piece of the daily signal.
