You know, so you know, and we've got John O'Connor joining us now, the legal analyst, author of Postgate. Hey, John, good morning, how are you good? Mar to Bill Well, lots to catch up on. I just want to touch on a couple of things here regarding Donald Trump. First of all, the Egene Carrol case. I guess she got some money, after all, judge ordered her to be paid, you know, a lot of money for you know, kind of a goofy court case here.

0:58 Well, it is and that's the one that really is the bothersome one. I mean, he ended up having to pay five million plus interests or about five six and you know, and I think that was the assault case. And you know what's odd about it is is that after that assault case, then he says, basically, which is his constitutional right, woman think to say that he was not guilty of a rape, and so therefore she sued him for defamation and she got fifty million dollars for that. Now that hasn't gone through the system, but I oh that one. Just first of all, the first the first thing, it's inherently unbelievable and incredible that one could carry off a rape in a dressing room at Bloomingdale's. It was just absolutely absurd. Oh, excuse me, keep your voice down, Gene, because I don't want the people that are right outside this room to know I'm raping you. It's just ridiculous.

1:58 And she's I think she probably had some sort of she may sincerely believe she was raped in some sort of a. Odd kind of a metaphorical sense. Well. And also people sometimes create memories, especially people that are psychologically screwed up, and things happened. And you know, you had that same thing with Brett Kavanaugh, where somebody sure that something happened, but nothing happened here. And that's the terrible thing about it is is there's so much Trump hatrod out there. I'm not saying knowing Trump. Trump probably when she's, you know, a good looking woman, he was probably came on to her in some way, but not. Trump is not a physical rapist. That's just not his history.

2:41 He's been a lot of. In a public in a public environment. I mean, that's not who he was, and he was a public character at the time. He's not going to go physically rape somebody. And there have been no reports of him privately raping anybody in a hotel room or whatever it might be. So this is not Harvey Weinstein. And it's just it made no sense. And John, what about what about the way that the lawsuit was conducted. The judge seemed to deflect and really limit Trump's defense on all this. Absolutely, oh absolutely, I mean the judge was I don't want to say in the tank because that would be a slur on him, but he was unduly biased in favor of Jean Carroll. And of course he hates Trump, like so many these people in New York do. And so, you know, I've litigated defamation cases and also assault cases.

3:40 This is actually the first. This was an assault case. And once you limit the testimony so that the main thing the jury sees is this testimony of the plaintiff, Yeah, yeah, I mean that sort of pushes them to a verdict and you know then then all you say, as well, it's a balancing thing, a little more preponderanceerance, she's more likely truthful than not. That's it. Then you're gonna lose that case. And so the judge has a big, big role to play in this. And I'm not saying he was doing something illegal or corruptly, just he just was biased against Trump.

4:25 Yeah, but how you know, what does this say about the legal system, John, I mean for anybody else that would go in and participate in the system, that you would get a profile person like Donald Trump and really, you know, kind of kind of run him over here. Well, that's right. And in California at least, and in some states you get an automatic disqualification of any one particular judge that you think is is biased. I don't think they have that in New York. So he gets stuck with his judge and maybe if you would have disqualified him, the next one would have been just as bad. But that's the problem with the system is you can have a seriously biased judge. Now you have this other problem, which is is that Trump is unlike any other litigant.

5:18 There's such incredible irrational hatred of Trump that it is very hard for the guy to get a fair trial in a place like New York, whoever is dealing with him, And you know, and some of it is the way our thought process is today. There is so much what I would call effective with an a effective thinking versus cognitive thinking that you put this together, and that's why there's so much hysteria about Trump. If you concentrate just on the atmospherics of Trump, his haircut, his bluster, his you know, his forceful personality, Oh, you could sell the guys.

6:00 The guy's a king. He thinks he's king. He's a terrible guy. Well you know this now, King's rally. He's not a king. He's just a guy with a lot of bluster. You know. Meanwhile, when Obama says in a real cool way, well I've got a pen and a phone. I don't need the legislature. What he's really saying is I'm going to be a king. Well Obama was a king, but he said it in a cool way. So everyd goes, oh, you're cool, that's okay. And if Trump blusters about something he's a king, well he's not really being an autocrat. Obama was, but he's a cool guy. Yeah, right, yeah, exactly. Well, and then of course here he presents his case to the country, not only to talk about Iran, and you've got networks going and we don't want anything to do with it, especially when he was talking about the issue of voting.

6:56 Right, that's right. The networks try to get around that price precisely because they have not covered this fully. I wrote an article about Kristen Welker on Meet the pressing all going nuclear on Trump that Gene, none of this has been proven, this vote stuff, and that's just not true. There's plenty of it. I think she said there was no evidence of any voter fraud, and that's just ridiculous. I wrote an article about it in the next few hours. It was so clear and just highlighted some of the tremendous proof of fraud. Now that doesn't mean you can overturn the election. You can prove fraud the way we prove facts. But our system is such that it should be the vote counting, the vote voting place. That is pretty much sacrisanct, and you can count on those. But if you don't, if that voting place goes out of whack and you have harvested ballots coming in, doesn't handle it if it's not managed, right, But a lawsuit's not going to do any good.

8:08 Right. Well, John, the electorate, the majority of the electorate says they don't trust you, know, the results of the twenty twenty election. I mean, this is the electorate itself. And it almost seems like the far left is using the twenty twenty election as a litmus test. You know, if you don't open up a bane and swear that you agree that Joe Biden was fairly elected president of the United States, you know, then you they're going to invalidate you and do all kinds of evil towards you. Who cares about free speech? Bill? Yeah, the words the two words election denial. You're a terrible person, and they can just stamp you because it's when you say election denial, what you're saying is you've got free speech rights except for this election. Oh unless, of course you're also a climate denier. You have no free speech right.

Us and John we were just saying about, you know, these confrontations that you have if you disagree with the left, even though there many times you know, twenty percent of an issue where eighty percent is. The preponderant issue. And if you don't agree with them on their twenty percent issue, then you know. You're out of the ballpark. And the whole concept of the left is to try to enforce their view of things in different ways. One of them is by the media saying, oh, you're a climate denier, you're an election denier and all that. Then the other thing they do is they have all these sites in which they talk about fact checking, and the fact checking is ridiculous. But there's that way of saying, Okay, this is untrue. You can't say that we're fact checking and all it is is a contrary opinion. But rather than saying it's my opinion that this is not true, No, that's not good enough. You have to say, we have checked.

14:51 And let me give you an example, the Washington Post. I looked at their three thousand lies that they said that Trump did under their fact checking, and let me give you and then if you repeat the same lie, that's a different lie. But for instance, Trump said he was building a border wall. Now that amounts to about a thousand lies that the Post said were there were lies a thousand? Now what was the lie? The Post said, and I'm not making this up, that he was wrong when he said he was building a border wall, when in fact he was building a fence. It was a ballard style fence. It wasn't a quote wall, and because it did not have continuous elements at the bottom and top.

15:39 In fact, they were wrong. They were wrong about this being a fence and not a wall, as the definition is. If you look at it, this is a wall. It has some slats in it, like the Great Wall of China. We think that's okay. Just because something has a hole or an outlet in it doesn't make it not all. But my point is that they were actually saying that that's a lie, that there was a. Wall being built. Come on, now, come on, now, that to me, you lose any credibility, but well, you use credibility who have from people who have critical thinking and are reasonable. But we've got so many people out there because of they're you know, Trump arrangement syndrome, call it what you want to call it. They're just so anti Trump and anti American is what they're you know, developing even more so, which is I think even more dangerous than Donald Trump.

16:32 But regardless, this is what's happening psychologically and socially with the American public. Right, that's right, And so we have the biggest enemies of truth we have out there are the mainstream media. They're not there and and some of it is is they're just they're trained to have a certain form of stupidity. They may not think they're stupid, but by ideological catalog, they are assuming the truth before the events in question, and they don't analyze it or at least have both sides weigh in, and so we don't have the kind of democratic discussion that has been the strength of our country.

The strength of America is is these groups get together, they argue with one another, they come up with solid compromises as to what is true and good and right and correct. But we don't do that anymore. Now we have these arbiters out there that are arbitrary. Well, John, when everything becomes and you know this from your legal background, when everything becomes emotionalized, it's weaponized in a sense, and it blocks any kind of conversation. If you think not, why don't you just go to a divorce court and see what happens there. Right exactly, and you bring up the idea of critical thinking.

18:02 Once our education system tries to teach you what is what you're supposed to believe versus teaching you how to think and go back and forth and think, now you're preparing a bunch of people who think there's one truth out there and I've just got to figure somebody's got to tell me what it is exactly. That's the way the communist countries work because you have an ideology that you must a priori believe, as opposed to reasoning and arguing. And so the strength of democracy is the people arguing about the pros and cons and then coming to an agreement or a compromise. But our education system is exactly against that. So what happens when someone leaves college and they're confronted with somebody like Trump. Oh, he's saying something that I don't know how to handle this. It's against its contrary to what I believe or Charlie Kirk. Oh, yeah, so you got to shoot him. You can't argue with them.

19:01 And here's Charlie out there trying to get people to argue and think and reason. They don't have to agree, but think. And so what happens, Well, that guy's preaching hate. He's not preaching him, So let's kill him. And that's a logical conclusion. Somebody's not doing the right thing that and this is hate. Anything that's against your position is hate speech. How do you know that's hate? Peach? But anyway, so you kill him. So there's where we are. It all makes sense if you believe that there is one side that is always right and anybody who's out there is not only wrong, but he's evil. Now you want to kill them. Yeah.

19:47 The one thing John that we're not hearing is of these kids that were on these college campuses that you know, confronted Charlie Kirk. What about testimonies from these kids whose lives were changed and altered as a result of that interaction with Charlie Kirk, because I saw Charlie Kirk as one who was looking out for the best interests of these young people, causing them to think critically, to think for a moment what they have been indoctrinated by and the classrooms that they came out of was it in their best benefit after everything was said and done. And I'd like to hear from these kids who confronted Charlie Kirk in one form or another. I mean, you can see the following of these kids that have become zealous because they realized, hey, we've been lied to, and they turned to turning Point and are now devote followers of But I'd like to hear, you know, more from these people.

20:43 But the mainstream media is not curious enough to even present that case. Sadly, well, that's the problem. That's the problem because the media is closed minded. Charlie Kirk succeeded in opening the minds of people, and that's what's so wonderful about is all of a sudden, these folks realize they've been lied to by this one dimensional you know process here and then what happens the one dimensional media comes out there and says, oh, no, you're going against the established truth. So that's the fight. The fight is between those people who are who are preaching freedom of thought. It is really against freedom of thought. Nobody would say it. Nobody's out there with a gun saying you have to do this.

21:29 But there are people out there that are trying to squelch tree thought, and it's just it's very sad. Is it good or evil? John? Well, it isn't good or evil, you know anything somebody says. But the overall effect of them stopping thought is really a very bad thing. I would say, I wouldn't call it evil. I just saw say it's completely destructive and bad. I don't think the people who who are promoting this type of censorship or necessarily evil. They may not know what they're doing. Lord forgive them, for they know not what they do.

22:11 But what's the endgame, though, John? What is the endgame? When you squelch conversation, you squelch the truth. What happens, Well, you become a communist, basically an ideologue. The whole thing is in favor of leftism of ideology, and ideology is against the whole idea of ideology. Whatever your ideology is, it's against the. Idea of ideas and clash of ideas in the marketplace of ideas, and ideology says this is the one ideology and you must believe it. So what we're doing when we introduce ideology is we're trying to get rid of free thought, free expression really the foundation of the republic.

22:58 And we can't do that. But you know, in any ideological country, you can't go over to China now and say, oh, by the way, I don't believe in communism. I don't believe in socialism, even though they actually are kind of free market over there. But in any. Place that's ideological, in his communism, there's only one way to think, and otherwise you get set to a re education camp in Siberia. Yeah, well, I guess if freedom doesn't matter to you, if it's irrelevant life, liberty to pursue happiness. Hey, if it doesn't matter, then I guess you know this is your Bailey Wick and God bless you. Right. The worst part about it is is it makes you poorer, not only intellectually, but the beauty. The reason this country has gotten so wealthy is because we have free thought and free thought then allows you to have somebody like Elon Musk say I like this country, I'm coming in and by the way, I'm going to invent a bunch of things, and Bill Gates to have the freedom to invent ms and go down the line. All of this comes from freedom, and it's unfortunate because you do not have any how many people in Cuba have come up with really innovative ideas that have improved our lives.

It's so good to be with you in Aloha to you, well, thank. You very much. I always appreciate the aloha, warm welcome, and it is That's one thing that's been consistent about the Islands. This is the aloha spirit. They say here. If you don't have the aloha, then you shouldn't be here. I think that's that's that's a good a good qualifier there. But anyway, lots to catch up on this big lie that keeps pouring out from the left that people are listening to. But they're really not adding the numbers up. This Medicare for all things and what it would cost, and somehow they have in their minds that it's going.

I don't know if that has changed much or not, but it wouldn't surprise me if it had changed. It had not changed that much because when the government gets involved, they want to create a one size fits all system. And we saw during COVID that one size does not fit all. If you're healthy, if you don't have pre existing conditions, if you're exercising, if you're taking care of yourself, the risk that you might have an illness is much different than the risk of somebody who is massively obese, or has diabetes, or has a long drawn out health history, or as an older person. So they're different, they're different, different things that have to be considered, which is why we always say protect the doctor patient relationship and make sure that doctors are helping you decide what's best for your own personal healthcare. Yeah, I mean by that time, God only knows how the cancer could have metastasized. Well, needless to say, he brought her home really quick and got her taken care of, which. Is very good. And that's what winds up happening oftentimes in Europe because they'll come to America, they'll go to another country, or they have paid.

And the thing is is the left will say, you know, like we're hearing famously out of New York and Mom Donnie, which is nothing new. Well, we're just going to go after the oligarchs. You know, we're going to have these billionaires and we're going to have them pay everything. Well, there's already studies been done said that if you want ahead, and this is according to the Washington Post, the editorial board noted that one hundred percent tax on billionaire, he took everything, took everything to fund our government. It would only fund it for thirteen months. And then where do you go?

33:45 Right, well, well, yeah, and then where do you go? Because you take everything from the billionaire and then he has nothing left to continue to create jobs, to create, to innovate, to build his company, to hire more people. When he hires more people, and he's building his companies. Whether and I'm thinking of Elain Moscuz I say this, but it can be a man or a woman. It doesn't matter which. They are creating. They're creating opportunities so that those families are able to take care of their own children and provide for their children's education and clothing and extracurricular activities and savings for the future and college funds, so they're helping grow the economy. You take all of that away, and all those employees will wind up no longer having their jobs, no longer having their opportunities, and what you may get in benefit to the federal government for thirteen months or so, you are going to lose very very quickly for all the people who were working from the jobs created from those who own companies.

34:48 Yeah, and Jeff Bezos even said as much here recently when he was asked directly about why doesn't he give more money? I mean, the audacity of people even asking that kind of a question without even, you know, doing any kind of research whatsoever and understanding how much Jeff Besos already gives and how generous he has been with the billions of dollars that he's generated over the lifetime of Amazon, and just said exactly what Elon Musk said, He's better off investing that money into his business for more jobs. And more growth. But you see, when you have an entity like the Democratic Party, which has become a.

They always good to you know, keep the truth up front and center here and you know, again, I don't know, it's just it has to be frustrating for you, John, I must think that you know, you run into all this deception that the mainstream media and these other people they're just so.

57:21 So disconnected from the truth or even have any kind. Of desire to give us the information that we need in order to make critical decisions. Right. Well, I mean, sometimes it's just ignorance of the facts. Sometimes, you know, you have what makes something newsworthy is different than kind of describing reality, and sometimes it is obvious bias that's there. So you know, it just depends on the issue and the time, you know, you take something like when they covered defensive gun uses. Over half of the case is that you see new stories on our instances where the criminal has been killed about forty three percent of the times the attacker has been wounded, and only about four percent are involved cases of brandishing, and most of those the criminals held at gunpoint. The problem is is that reality about ninety five percent of the time that people use guns defensively, simply brandishing is enough to cause a criminal to go and break off an attack.

58:31 You know, you have less than one percent of the times the attacker killed or wounded, So you know, but if you just listen to the news, you think the vast majority of time people fire their guns and the attackers are killed or. At least wounded. But you know, if you're a editor of a news bureau and you have two stories that come across your desk. In one case, there's a dead body on the ground, in another case, a woman's brandished a gun, would be criminals run away, no shots are fed, no dead body on the ground, you're not even sure what crime would have been committed. I think most of us would go and run with the story of the dead body on the ground versus the case where we're not even completely sure what crime would have been committed. But you know, people need to understand that what makes something newsworthy doesn't always reflect reality that's there, and it can give people.

59:24 You know, from a policy perspective, we care about the fact that the woman was able to go and defend herself and stop a crime from occurring. But you know, so that's part of it, but there's also a lot of bias out there. I mean, you know, we collect stories where, according to police, civilians use guns to stop what otherwise would have been a mass public shooting. There's over fifty of these cases that we have on our website at crimeresearch dot Org over just the last five years. And these almost never get any type a national news coverage. They get some local news coverage, but you know, there's so many biases that occur in the media coverage. So for example, probably one of my biggest pet peeves is time after time in the diaries of manifestos of these mass murders, they explain why they pick the target that they do. You know, they may be crazy in some sense, but they're not stupid. Their goal is to get media coverage, and they explicitly say if they can kill more people, they know they can get more media coverage, and so they go to gun free zones, They go to places where they know they're victims are not able to go and defend themselves.

1:00:43 Because they know they'll be able to go. And kill more people and get more media coverage. And yet you will search in vain even though the media frequently will cover the diaries of manifestos, and we'll mention things like, you know, the mass murderer talked about what he, you know, learn from other mass murderers there, but they won't say what he learned. And what they always learn is that they go to these gun free zones. They explicitly say it. And I want someone to provide for me a benign explanation for why these these murderers pick the targets that they do to warn people what goes through their minds in terms of how they picked their targets.

Yeah, it's it is amazing to me, John, because it seems that, you know, people purposely are ignoring common sense, you know, for the sake of a click and headliness. As you said. Early on here, you know you write here recently, conventional wisdom holds the United States is the most violent and dangerous nation in the developed world. I'm the conventional wisdom that has been influenced and prejudiced by this misinformation and these missed that are out there.

1:02:09 Yeah, well, I mean the media obviously is responsible for people believing this. Look what people compare when they look with the media compares when they look. At crime rates. Are crimes report to the police? People need to understand that most crimes aren't report to police, and the rate that people report crimes to the police varies across countries fairly dramatically. I'll give you a simple example. If you look at rapes and sexual assaults in the United States, about forty five percent of rapes and sexual assaults report to police. In Australia, according to the Australian Bureau of Statistics, they say it's nineteen percent. I think it's lower, but let's just take their number of nineteen percent just for sake of argument, assume that the true rape and sexual assault rate was identical in the United States and Australia.

1:03:00 Five percent are getting reported to police in the United States and only nineteen percent are getting reported to the police in Australia. If you just look at reported numbers, it would look like the rape and sexual assault rate in the United States is more than twice what it is in Australia. But in fact, when you look at the total rape and sexual assaults in both countries, not just the ones that are reported to police. The rape and sexual assault rate in Australia is three times higher than the rate in the United States. People simply aren't reporting the crimes to the police in Australia. The same is true with other countries that we have data for. You know, Canada, for example, the violent crime rate there, if you look at total and not just what's reported to police, is almost three times higher in Canada than in the United States. And you know, it really gives people a misimpression of how violent it is if you just look at report Here's the thing. Americans are more likely to report crimes to the police because they think it's more likely that the criminals are going to be caught and punished. If you don't think the criminals are going to be caught and punished. I recently gave a talk.

1:04:15 I was in Australia in February giving a number of talks, and one of the talks I gave was to university students in New South Wales and there were a number of women there and I was talking about the low rate that rapes and sexual assaults are report to police. And I had previously had communications with a prosecutor for that state in Australia who said, look, you know, they just rarely prosecute rape and sexual assault criminals. And when you talk to the women, they say, you know, what's the point of us going and reporting these It's embarrassing for us to come forward, you know, if you're unlikely to charge these individuals and you're not going to follow through in the prosecution. This they you know, it was amazing, but all the women that were there basically were shaking their heads saying, yeah, you know, what's the point of reporting these? So I mean, we may have problems in the United States, and we certainly do in terms of how well police are able to go and handle certain situations, but the problems are much much worse in many other countries.
